The course I wish I had taken

The training I would have liked to attend. ⚖️

On Wednesday morning, I changed hats… or rather, wore several at once. 😊

Together with my fellow lawyer Jacques Messeca, I co-direct the continuing education programme in sports law at the École de Formation du Barreau. For the first time, I also contributed by delivering part of the training.

The morning was devoted to “Sports justice: procedural rules and dispute management”, covering sports litigation before national courts and the Court of Arbitration for Sport (CAS), on which I spoke in particular.

With a fairly simple idea: to offer the training I would have liked to have had when I first began appearing before CAS.

Not just rules and theory, but a case to work through together from start to finish.

How do you bring a case before CAS in practice? How do you develop your strategy? What should you do as soon as a case begins? How should you approach a request for provisional measures and urgency? What pitfalls should you avoid?

Practical case studies, tools and, above all, discussions about what really happens when representing a client before CAS.

Sophie Dion and I were also able to compare our perspectives: mine as a lawyer who regularly appears before CAS, and hers as a CAS arbitrator. I was also able to enrich these discussions with my experience as an arbitrator with Sport Resolutions.

Two different seats at the table and two ways of approaching the same case.

I was particularly pleased by the discussions and feedback from fellow lawyers at the end of the morning.

Because passing on knowledge is also something I love about our profession. And being able to share some of the tools I would have liked to have had when starting out makes the exercise even more meaningful.

Thank you to Gilles Accomando, Director of Continuing Education, Jacques, Sophie and, of course, the fellow lawyers present, for the quality and spontaneity of our discussions.
